By signing up for or using CloudBaseIndia services, you agree to these Terms of Service ("Terms"). Please read carefully.
1. Account
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
2. Acceptable Use
Your use must comply with our Acceptable Use Policy. Prohibited content includes anything illegal, malicious, infringing, or harmful.
3. Service Availability
We provide a 99.99% uptime guarantee per our SLA. Scheduled maintenance is announced 7 days in advance where possible.
4. Billing
Fees are charged in advance. All Indian customers are charged 18% GST. Late payments may result in service suspension after 7 days.
5. Refunds
30-day money-back guarantee on shared, WordPress, and reseller plans. See Refund Policy for exclusions.
6. Intellectual Property
You retain ownership of content you upload. We retain ownership of our software, branding, and infrastructure.
7. Data Processing
We process your data per our Privacy Policy and DPA. You remain the data controller for end-user data on your servers.
8. Disclaimers
Services are provided "as is". We disclaim implied warranties of merchantability or fitness for a particular purpose to the maximum extent allowed.
9. Limitation of Liability
Our maximum liability is limited to fees paid in the preceding 12 months. We are not liable for indirect, consequential, or special damages.
10. Indemnification
You agree to indemnify CloudBaseIndia against claims arising from your use of services or violation of these Terms.
11. Termination
We may suspend or terminate accounts for breach of these Terms, non-payment, or AUP violations with reasonable notice.
12. Modifications
We may modify Terms with 30 days' notice. Continued use after the effective date constitutes acceptance.
13. Governing Law
These Terms are governed by Indian law. Disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
